Terms of Service
These Terms of Service ("Terms") govern your access to and use of Anvixa AI (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
Accounts
You must provide accurate information and maintain the security of your account. You are responsible for activities that occur under your account.
Service limits
Each account is limited to:
- One (1) Brand Kit per account
- One (1) Website per brand
These limits are subject to change. Contact us if you require additional capacity for your business needs.
Billing, refunds, and cancellation
ALL SALES ARE FINAL. NO REFUNDS WILL BE ISSUED UNDER ANY CIRCUMSTANCES.
By subscribing to or purchasing any plan, product, or service from Anvixa, you expressly acknowledge and agree to the following:
- No refunds: All payments are final and non-refundable. This includes monthly subscriptions, annual subscriptions, one-time purchases, and any other fees paid to Anvixa. We do not offer refunds for any reason, including but not limited to: dissatisfaction with the Service, failure to use the Service, technical issues, changes to your business needs, or cancellation of your subscription.
- No partial refunds: If you cancel your subscription, you will retain access until the end of your current billing period, but no prorated or partial refunds will be issued for unused time.
- No credits: We do not issue account credits, store credits, or any form of compensation in lieu of refunds.
- Subscription cancellation: You may cancel your subscription at any time through the Stripe billing portal. Cancellation will stop future billing but does not entitle you to any refund for the current or any previous billing period.
- Automatic renewal: Subscriptions automatically renew at the end of each billing period. It is your responsibility to cancel before the renewal date if you do not wish to continue. Failure to cancel before renewal does not entitle you to a refund.
CHARGEBACKS AND DISPUTES: By using the Service and making any payment, you agree that you will not file a chargeback, dispute, or payment reversal with your bank, credit card company, or payment provider for any charges made by Anvixa. You acknowledge that:
- Filing a chargeback or dispute constitutes a breach of these Terms.
- If you file a chargeback or dispute, your account will be immediately and permanently terminated without notice.
- You waive any right to recover any funds through chargeback or dispute mechanisms after agreeing to these Terms.
- We reserve the right to pursue all available legal remedies, including recovery of the disputed amount plus all associated fees, costs, and damages incurred as a result of any chargeback or dispute.
- We may report fraudulent chargebacks to credit bureaus and fraud prevention databases.
By completing any purchase or subscription, you confirm that you have read, understood, and agree to this no-refund policy. If you do not agree to this policy, do not subscribe to or purchase any services from Anvixa.
Acceptable use
- Do not misuse the Service or attempt to access it in unauthorized ways.
- Do not upload or generate content that violates laws or third-party rights.
- Do not interfere with the reliability or security of the Service.
Content and ownership
You retain ownership of content you upload to the Service. By using the Service, you grant Anvixa the rights necessary to operate and provide the Service (for example, storing, processing, and displaying your content).
Regarding AI-generated content: Content generated by our AI tools (including logos, images, social media posts, websites, and other creative assets) is provided to you for your use, but Anvixa makes no representations or warranties regarding ownership or intellectual property rights in AI-generated outputs. The legal status of AI-generated content varies by jurisdiction and is an evolving area of law.
AI-generated content and intellectual property risks
IMPORTANT: Anvixa uses third-party AI services including Google Gemini and FLUX (Black Forest Labs) to generate content. These AI systems may inadvertently produce content that resembles existing copyrighted material, trademarks, or other protected intellectual property.
You acknowledge and agree that:
- No IP guarantees: Anvixa does not and cannot guarantee that AI-generated content is free from intellectual property claims, copyright issues, trademark conflicts, or other legal concerns. AI models are trained on large datasets and may produce outputs that unintentionally resemble protected works.
- Your responsibility: You are solely responsible for reviewing, verifying, and clearing all AI-generated content before use. This includes checking for potential trademark conflicts, copyright issues, and ensuring the content is suitable for your intended purpose.
- No legal advice: Anvixa does not provide legal advice regarding intellectual property. If you have concerns about using AI-generated content, you should consult with a qualified attorney.
- Commercial use at your own risk: If you use AI-generated content for commercial purposes, you do so entirely at your own risk. Anvixa is not liable for any claims, damages, or losses arising from your use of AI-generated content.
- Third-party claims: If any third party claims that content generated through our Service infringes their intellectual property rights, you are solely responsible for addressing such claims. Anvixa has no obligation to defend, indemnify, or hold you harmless against such claims.
Indemnification
You agree to indemnify, defend, and hold harmless Anvixa, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service or any AI-generated content
- Any claim that content you created, uploaded, or generated through the Service infringes any third-party intellectual property rights
- Your violation of these Terms or any applicable law
- Any dispute between you and a third party regarding content generated through the Service
DMCA and copyright complaints
Anvixa respects the intellectual property rights of others. If you believe that content on our Service infringes your copyright, you may submit a DMCA takedown notice to our designated agent at dmca@anvixa.app with the following information:
- A physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work claimed to be infringed
- Identification of the material to be removed and its location on the Service
- Your contact information (address, phone number, email)
- A statement that you have a good faith belief that use of the material is not authorized
- A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner
We will respond to valid DMCA notices and may remove or disable access to allegedly infringing content. Repeat infringers may have their accounts terminated.
Content retention and deletion
IMPORTANT: All user-generated content, including but not limited to brand assets, social media posts, images, and website files, is automatically deleted after fifteen (15) days.
You are solely responsible for downloading and backing up any content you wish to retain before the automatic deletion period. Anvixa is not responsible for any data loss resulting from this automatic deletion policy. We strongly recommend exporting your content regularly.
Third-party services
The Service may rely on third-party services (such as authentication, storage, or email delivery). Their terms may apply when you use those services.
Social media platform compliance
Anvixa integrates with third-party social media platforms including Meta (Facebook and Instagram) for publishing content. By using our publishing features, you acknowledge and agree that:
- Platform terms apply: Your use of social media publishing features is subject to the terms and policies of the respective platforms, including but not limited to Meta's Terms of Service, Instagram Terms of Use, and their Community Guidelines.
- Account responsibility: You are solely responsible for maintaining your social media accounts in good standing and ensuring your published content complies with all applicable platform policies.
- No guarantees: Anvixa does not guarantee that content will be successfully published to any third-party platform. Publishing may fail due to platform API changes, rate limits, content policy violations, or other factors outside our control.
- Token management: You authorize Anvixa to store and use access tokens to publish content on your behalf. You may revoke this access at any time by disconnecting your accounts.
- Platform changes: Third-party platforms may change their APIs, policies, or terms at any time. Such changes may affect or disable publishing features without notice. Anvixa is not liable for any disruption caused by third-party platform changes.
- Content responsibility: You are solely responsible for ensuring that content published through our Service complies with all applicable platform policies. Anvixa is not responsible if your content is removed or your accounts are suspended by third-party platforms.
Support and service level
For support inquiries, please contact us at support@anvixa.app.
Response times: We aim to respond to support requests within 48-72 business hours. However, this is a target, not a guarantee. Response times may vary based on inquiry volume and complexity.
Service availability: We strive to maintain high availability of the Service but do not guarantee any specific uptime percentage. The Service may be unavailable due to scheduled maintenance, unscheduled outages, or factors beyond our control. We are not liable for any losses or damages resulting from Service unavailability.
No SLA: Anvixa does not offer a formal Service Level Agreement (SLA) with guaranteed uptime or response times. The Service is provided on an "as available" basis.
Security reporting
If you discover a security vulnerability in our Service, please report it responsibly to security@anvixa.app. We appreciate the security research community's efforts in helping keep our users safe.
Responsible disclosure: Please give us reasonable time to investigate and address any reported vulnerabilities before making any information public. We ask that you:
- Not access or modify other users' data
- Not perform actions that could harm the Service or its users
- Not use automated scanning tools that generate excessive traffic
- Provide sufficient information to reproduce and verify the vulnerability
No bug bounty: Anvixa does not currently operate a bug bounty program and does not offer monetary rewards for security reports. We will acknowledge valid reports and work to address confirmed vulnerabilities.
Termination
We may suspend or terminate access to the Service if you violate these Terms or if required to protect the Service or other users.
Disclaimers
The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted or error-free.
Security disclaimer
IMPORTANT: Anvixa makes no guarantees regarding the security of the Service against unauthorized access, data breaches, or cyberattacks. Even the world's largest technology and cybersecurity companies experience security incidents. As a content creation platform, Anvixa cannot and does not warrant that the Service will be immune to hacking, data breaches, or other security vulnerabilities.
You acknowledge and agree that you use the Service at your own risk, and Anvixa shall not be held liable for any damages, losses, or harm resulting from security breaches, unauthorized access to your account or data, or any other security-related incidents. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
AI-generated content disclaimer
TO REITERATE: AI-generated content is provided "AS IS" without any warranties whatsoever.
Anvixa does not guarantee the accuracy, completeness, originality, non-infringement, or suitability of AI-generated content for any purpose. Our AI tools (powered by Google Gemini and FLUX) may produce content that is factually incorrect, offensive, inappropriate, or that resembles existing copyrighted or trademarked material. You are solely responsible for:
- Reviewing all AI-generated content before use
- Verifying accuracy and appropriateness
- Checking for potential intellectual property conflicts
- Ensuring compliance with applicable laws and regulations
- Obtaining any necessary licenses or permissions for commercial use
Anvixa expressly disclaims all liability for any claims, damages, or losses arising from your use of AI-generated content, including but not limited to intellectual property infringement claims, defamation, or any other legal action brought by third parties.
Limitation of liability
To the maximum extent permitted by law, Anvixa will not be liable for any indirect, incidental, or consequential damages arising out of or related to your use of the Service.
Changes to these Terms
We may update these Terms from time to time. We will update the effective date when changes are made.
